This is Det. Schaffner of the Clearwater Police Department. It is currently Monday, 5/19/97. The time is 1745 hours. I'm presently at 1540 Gulf Boulevard, Apt. xxxx. This will be in reference to Case #97-09442. The victim's name is Michael Pattinson. Address of occurrence is 200 N. Osceola Avenue. The incident is False Imprisonment. It occurred on 6/19/96. With me here in the apartment is Det. Tom Miller and Michael Pattinson.

Det. Schaffner: Okay, I'm gonna put the tape recorder down. Okay Mike, do you know you're being tape recorded?
Pattinson: Yes, I do.
Det. Schaffner: Okay. For the tape recorder, could you spell your first, middle, and last name?
Pattinson: Yes. Michael...M I C H A E L...Philip... P H I L I P...Pattinson... P A T T I N S O N.
Det. Schaffner: Okay. And what is your date of birth?
Pattinson: 4th of July, 1949.
Det. Schaffner: And what is your residence?
Pattinson: Right now it's 1540 Gulf Boulevard, Clearwater, Florida.
Det. Schaffner: Okay. Once again, you know you're being tape recorded. Are you making these statements freely and voluntarily?
Pattinson: Absolutely.
Det. Schaffner: And it's in regards to the case we've been talking about that occurred at 200 N. Osceola Avenue?
Pattinson: That's right.
Det. Schaffner: Okay. This incident occurred on what date?
Pattinson: It occurred...occurred on June 19, 1996 in the afternoon..early afternoon.
Det. Schaffner: And that address of 200 N. Osceola...what is at that address?
Pattinson: That is the Sandcastle Hotel and Technical Building for the Church of Scientology.
Det. Schaffner: Okay. Let's start with that day and briefly discuss what happened. How did...how did you arrive at that location?
Pattinson: I received a call from Cosima asking me to come in for an interview.
Det. Schaffner: Cosima?
Pattinson: Cosima...yes.
Det. Schaffner: Do you know how to spell that?
Pattinson: C O S I M A.
Det. Schaffner: And she's who with the Church?
Pattinson: She is a Public Master At Arms. She is an Italian lady. I don't know her family name but her name is Cosima.
Det. Schaffner: Okay. And she called you at your residence here?
Pattinson: Here...yes.
Det. Schaffner: Okay. Go ahead.
Pattinson: And I didn't want to go in because I was very very busy. But in the end, I agreed to go in for an interview.
Det. Schaffner: About what time was this...you recall?
Pattinson: It was just after Iunch.
Det. Schaffner: Okay.
Pattinson: And so I went in for the interview. And I arrived and she took me into her office. And then we started an interview at that time.
Det. Schaffner: Okay. Who was in the office with you?
Pattinson: Just her.
Det. Schaffner: Okay. And what did the interview consist of?
Pattinson: Well, it was rather an unusual one in that it was not the normal Scientology procedures at all. I won't go into all the details of that, but basically it was something which was not in alignment with the writings of Ron Hubbard, And so I was objecting very strongly to what was going on. And she was telling me that the case supervisor...my case superrisor...had told me that i needed to get what's called a Sec Chek...a Security Chek.
Det. Schaffner: Can you briefly for the record...what is sec? Are you talking about S E C?
Pattinson: Yes. S E C and then C H E K.
Det. Schaffner: Okay.
Pattinson: Security Chek. It's like a Scientology auditing procedure, which is not a formal so called session...like it's not counseling. It's basically finding out if you've done any discredible acts on the E Meter and then writing them down in a folder.
Det. Schaffner: And that's why Cosima wanted to talk to you?
Pattinson: That's right. But I knew this was gonna cost some money and I did not want to do that.
Det. Schaffner: Well, how much does a Sec Chek cost?
Pattinson: Well, it can be anything. Starting at $7,400 for my particular case level...level in Scientology. And if it takes more than one 12 1/2 hour block, then it can be doubled or tripled or quadrupled. There's no limit to how long it could go on.
Det. Schaffner: And how long does this last?
Pattinson: Uh...well, each block of 12 1/2 hours would be delivered within about a week or two.
Det. Schaffner: Okay. So she discussed this with you?
Pattinson: She just said that that's what I needed to have. And I disagreed with her. I did not want that because that was not the problem I was trying to solve. That was just...it was a completely wrong so called solution. And then she proceeded to read reports which I had written about various behaviors of staff members of the Church of Scientology over there. But saying that I was being critical of them and there was something wrong with me...therefore, I needed to buy a Sec Chek in order to handle my problem because I was critical. It was like it was completely backwards from the actual truth of the matter.
Det. Schaffner: Okay. Did you want...did you get this Sec Chek?
Pattinson: No.
Det. Schaffner: Okay. At what point did you tell her that you did not want this procedure?
Pattinson: Oh several times in that interview.
Det. Schaffner: Okay. What did she do after you told her the last time that you did not want this?
Pattinson: She asked me...well, she...she just said "follow me." But prior to that, I'd been writing notes in the interview just so that...it was going so badly that I just wanted a record of it because I'd had interviews with her before which had not gone well. So I wrote down notes of what occurred in that particular interview. Then she said "okay, come with me" and she led me to Hy Levy's office.
Det. Schaffner: Okay. Now Hy Levy's office is in the same building?
Pattinson: Yes.
Det. Schaffner: And about how far away is that?
Pattinson: Oh...30 or 40 yards or so.
Det. Schaffner: Okay. So you voluntarily went with her to Hy Levy's office?
Pattinson: Yeah.
Det. Schaffner: Okay. When you got to Hy Levy's offrce, what did you do there?
Pattinson: Umm...I went into the room. I sat down at his desk and Hy was at his desk. Cosima sat down behind him. And Cosima proceeded to explain to Hy that the case supervisor had decided that I needed to have a Sec Chek right now and that I should get that done.
Det. Schaffner: Okay.
Pattinson: And I said I was not interested in doing that. And they proceeded to try and persuade me to do so. I said "Listen, I can't afford to do this...I don't want to have this...I have no intention of doing this at all." Besides, I knew I would not do it, mostly because it had been done before where I had been coerced into buying $7,400 worth of auditing on the Freewinds ship against my will in 1991. Det. Schaffner: Was there anybody else in the office?
Pattinson: Just the...just three of us.
Det. Schaffner: Just the three. Okay. At what point did you finally convince them that you did not want this procedure and you wanted to leave?
Pattinson: Oh, I told them several times "Listen, I want to leave...I don't want to have this..this interview...I don't want the service...and I'm not buying anything...I'm not gonna borrow any money." And Hy was saying "Look, who can you borrow the money from?...Can you borrow it from Rick Asano...could you borrow it from Elina Maya over in Mexico?...who could you borrow it from?" I said "I'm not borrowing from anybody...I don't want this service...I'm not interested in it and I'm not gonna do it." I was very firm....just like I'm speaking to you now. "I will not do this." And they just over-rode.. .everything I said, they just ignored it.
Det. Schaffner: Okay. Were you free to leave?
Pattinson: I...I thought I was.
Det. Schaffner: Okay. Did you try to leave?
Pattinson: Yes, after about 20 or 25 minutes of this slinging back and forth of like "I'm not going to pay you for this stuff...I don't want this service" and "Yes you are...you're not leaving this office until this money is paid and you have this Sec Chek" I said "This is not gonna occur." And in the end I...after about 25 minutes...something like that...I took my folder...my photograph album, which I had with me...and I got up slowly and I said "Listen, I'm sorry, this interview is gonna end...I'm not gonna do this" and...you know "So long for now." And I turned towards the door and Cosima came in between me and the door. And then Hy came in between me and the door and blocked the door. I got it open a couple of inches and they stopped me from leaving the office even though I wanted to leave. Prior to that...I just want to say...I had said on two or three occasions "Listen, I'm being held here against my will...I do not wish to be here...you're gonna have to let me go...I don't want this service...I'm not interested in your arguments anymore...I want to leave."
Det. Schaffner: And this was the first time that you actually tried to get up and leave?
Pattinson: Yes, that's correct...I...
Det. Schaffner: But they both stood in front of the door?
Pattinson: Yes.
Det. Schaffner: Now the door...there's two doors to the office?
Pattinson: Yes.
Det. Schaffner: This particular door...how does it open?
Pattinson: It opens inwards.
Det. Schaffner: So they were standing in front of the door...so you would've had to pull the door towards you.
Pattinson: Yes.
Det. Schaffner: The door would not open with them there.
Pattinson: Exactly. It opened a few inches and then they pushed their bodies against it and it closed again.
Det. Schaffner: And you told them that you wanted to leave?
Pattinson: Yes, I did.
Det. Schaffner: And what did they tell you?
Pattinson: "We're not finished...you haven't got the intensive yet....you sit down...sit down...be calm." And by this time I was in tears frankly. I was emotionally very very upset.
Det. Schaffner: Who told this to you...that you could not leave?
Pattinson: Hy Levy told me I couldn't leave without doing that. He said it several times.
Det. Schaffner: It was Hy speaking that you can not leave.
Pattinson: Yes.
Det. Schaffner: And they both were standing in front of the door?
Pattinson: That's correct.
Det. Schafiner: Okay. Did this get turned into a physical confrontation?
Pattinson: I didn't want to hit anybody. I didn't want to become physically violent with anybody and I did not at anytime. However, it was like...you know...just like a soft contact kind thing like I want to leave but there's two bodies standing between me and the door. I tried to pull the door but it was just not possible. So then I let go of the door knob, and at that point I think I just broke into tears because I couldn't stand it any longer.
Det. Schaffner: Did you push either one of them?
Pattinson: No.
Det. Schaffner: Did they push you?
Pattinson: It was a very gentle pushing, but it was a...it was a pushing so I could not leave. I was being actually physically prevented from leaving.
Det. Schaffner: And who was doing this?
Pattinson: Hy and Cosima.
Det. Schaffner: Both of them?
Pattinson: Yes.
Det. Schaffner: Which one of them actually physically prevented you from leaving by pushing you?
Pattinson: Hy Levy.
Det. Schaffner: Hy did?
Pattinson: Yes. It was not a violent pushing. It was just a "you're gonna stay

here" push.

Det. Schaffner: How did he push you? With one hand...two hands? Where did he touch you at?
Pattinson: Put it on the shoulder and on top...top of the arm.
Det. Schaffner: With...with one hand...two hands?
Pattinson: No, it was just like...I think...I...I don't remember very well that particular part, but I know that I couldn't leave without actually...you know...punching them out or something and I wasn't gonna do that as I was a member of the Church at that time.
Det. Schaffner: Did you...did you try and get help?
Pattinson: Yes.
Det. Schaffner: How did you do this?
Pattinson: I shouted for help through the door, which was like very partially open...I managed to get it open one or two times and I shouted for help. But I was...by this time I was very emotionally upset and I was like shouting for help.
Det. Schaffner: Who would have been outside to hear you?
Pattinson: The receptionist at the Registrar's Office. There was the cashier in a booth. Persons in the IAS Office over the whole...and possibly some public persons who may have been waiting there.
Det. Schaffner: So the door that opens up into a lobby area where there's other offices inside?
Pattinson: Yes. Those offices...some of them don't have doors on them and they wouldte been...I...I'm pretty sure somebody heard me.
Det. Schaffner: Did anybody acknowledge that they heard you?
Pattinson: No.
Det. Schaffner: Did you see anybody look in your direction when you were yelling help?
Pattinson: No, I didn't.
Det. Schaffner: So after..after this happened, you did not go out the door, right?
Pattinson: No, I did not go outside. I was unable to go out of that door. I stood against the wall for about five minutes because I was in tears and I was very very upset. And they were trying to calm me down.
Det. Schaffner: What did you do then?
Pattinson: I sat back down again after five minutes. And then Hy Levy proceeded to tell me that, if I didn't want this..to pay this money and to have this auditing procedure...that there was something wrong with me...that my integrity was suspect,..that I was not a good Scientologist...that basically he was like what's called invalidation. It's like putting somebody down.
Det. Schaffner: To invalidate someone is to put them down?
Pattinson: That's right...yes. It's like...you have something which is valid. Then you would say that that's invalid...it's just like making it wrong or criticizing it. So we went on with that for quite a...quite a time. Then he was still saying "Listen, we're gonna do this...you're not leaving here until this is done." And then Cosima was agreeing with that and that worked.
Det. Schaffner: Where was Hy at this time?
Pattinson: He was back behind the desk again sitting down.
Det. Schaffner: And where was Cosima?
Pattinson: Behind me again on my lefthand side.
Det. Schaffner: Was she sitting down also?
Pattinson: Yes.
Det. Schaffner: So there was at least three chairs in this office?
Pattinson: Yeah, probably four chairs. Four chairs actually...yeah, there were four chairs in the office at that time.
Det. Schaffner: Approximately how big is the office?
Pattinson: About 9' x 9' approltimately. I can't be sure about that. It may be even smaller than that.
Det. Schaffner: Was there any windows to the office?
Pattinson: Yeah. One big window which doesn't open. And a door next to that, which goes out...straight out to the garden.
Det. Schaffner: Okay. So then what happened after you sat back down and everybody else was sitting down?
Pattinson: Well, I was in tears. I was...I mean...l was weeping because frankly the emotional upset...not just of that but of the whole last six years of my relationship with the Church of Scientofogy has been a nightmare. And frankly I've had to hold it within myself all the time. At that time, it was like a breakdown. I just couldn't stand it anymore because I was being held against my will. I told them so and they would not let me out of the mom.
Det. Schaffner: You told both of them that they were holding you against your will?
Pattinson: Yes, I did.
Det. Schaffner: And that you wanted to leave?
Pattinson: Yes, I did. I...maybe two or three times.
Det. Schaffner: Okay.
Pattinson: And I was crying and they were still trying to encourage me to do this because that was...that was the solution and that's what would save me. And I knew that was absolutely not true at all. I did not want that. I'd already been there and done that.
Det. Schaffner: You're talking about the...
Pattinson: The Sec Chek.
Det. Schaffner: The Sec Chek.
Pattinson: I've already been there and done that. I've already spent God knows how much money on that with no resolve whatsoever.
Det. Schaffner: Okay.
Pattinson: Because the fault was not mine in the first place in this particular case.
Det. Schaffner: And then what happened?
Pattinson: Then I was...when I started to recover, which was probably about 20 minutes...20 to 25 minutes later...I thought to myself "okay, I'm not gonna be able to get out of here unless I devise a plan to escape." And so I looked at that door...or the other door that went out to the garden. I just said to myself "I hope that door is not locked because I'm gonna go through it." And so I said to myself "Okay...I'm gonna pick up my album...I'm gonna make it look like I'm gonna go back out of the door again, which I just was prevented from going out before."
Det. Schaffner: That's the door that leads into the lobby area?
Pattinson: That's right.
Det. Schaffner: Okay.
Pattinson: I said "I'm gonna make it look like I'm gonna try and go through that door again because they're gonna put themselves between me again" which they did. "And at that point, I'm gonna make a break for the other door...hope it's not locked...and bolt...get out of here...I'm gonna escape." Because they were not gonna let me out of there until I paid them. I had no intention of doing that. I had to get back and work.
Det. Schaffner: Who...who demanded you pay the money?
Pattinson: Hy Levy.
Det. Schaffner: And what...what was the demand amount?
Pattinson: $7,400 as...as a starting fee. That would...it probably would've been more if it had gone over 12 1/2 hours.
Det. Schaffner: And that's what you would have to pay before you could get out of this office?
Pattinson: Yes, that's conect.
Det. Schaffner: Okay.
Pattinson: And the ploy worked because they did put themselves between me and the door again as they did the first time. At that time, I...I went very very fast through the other door, which was not locked thank God. And I bolted straight across the garden...past the fountain...and they were chasing me by this time...physically chasing me towards my car. And I made it to my car just before them up on Osceola Avenue. And they tried to shut the door of the car as I was opening it but they didn't succeed. I got in the car. I wa, able to maneuver out of the position and go home. I was very very shaken indeed...emotionally totally drained. But they didn't try...you know...didn't stand in front of the car, so I didn't do anything violent to them. But I did nothing violent against them at anytime .
Det. Schaffner: Okay. Then you drove away?
Pattinson: Yes. I drove away. I went home.
Det. Schaffner: How did you deal with this situation involving Hy and Cosima? What I mean by that...did you initiate contact with them after this incident?
Pattinson: Well, on the 19th I was still very very upset. But I had to work a lot, so I didn't do anything on that particular day. The next day I was also extremely busy, so I tried to keep my attention on my..my perfection of my work rather than thinking about the emotional upset which I had had.
Det. Schaffner: You're an artist, correct?
Pattinson: Right, I'm an artist. I was doing the painting for donation to the Florida Orchestra and it had to be done. It had to be ready and delivered. And so then I got to thinking that my manners were not good in...in England. I'm a British person, so in England like when you get upset with somebody emotionally, it's considered very very bad manners. And I felt that they might get into trouble if somebody had heard or what...whatever. I spoke to Mary Vodgeding a little bit about what had occurred.
Det. Schaffner: Can we back up a little. Mary who?
Pattinson: Mary Vodgeding.
Det. Schaffner: Can you spell the last name?
Pattinson: V O D G E D I N G.
Det. Schaffner: And who is Mary?
Pattinson: She's the President of the Flag Service Organization.
Det. Schaffner: And where is that located at?
Pattinson: On Ft. Harrison in Clearwater.
Det. Schaffner: And you had spoken to Mary about this incident?
Pattinson: Yes, very briefly on the phone the next day..yes.
Det. Schaffner: Okay.
Pattinson: I told her what had occurred and I realized that they may get into very serious trouble within the Church. And I was still a Scientologist at that particular point.
Det. Schaffner: They meaning Cosima and Hy?
Pattinson: Cosima and Hy...yes. And so I...I faxed them...I think it was on the 21st...a letter of apology for my emotional behavior and my impoliteness because I felt that my manners were wrong. But in retrospect now, I feel that I was justified in having those emotions.
Det. Schaffner: Okay. And who did you fax it to?
Pattinson: I faxed it to Hy and to Cosima.
Det. Schaffner: And..well, in summary were the letters identical or...
Pattinson: No. They were just...well, they...they were pretty similar.
Det. Schaffner: And what was..what was being said in these letters?
Pattinson: Basically that I was apologizing for my impoliteness and my behavior because I had not...I wasn't used to having emotional outbursts. I'm known as a very reserved type of person, so that was like very out of character for me.
Det. Schaffner: Okay.
Pattinson: And I apologized to Hy and to Cosima for my behavior. Actually...I mean I should never have gone to see Hy. Cosima should never have taken me there because I had no intention whatsoever of doing that again.
Det. Schaffner: Okay.
Pattinson: But I mean I was worried...
Det. Schaffner: So you faxed letters to them?
Pattinson: Yes, I did.
Det. Schaffner: Apologizing for the way you...you acted?
Pattinson: For my emotional outburst, yes.
Det. Schaffner: Okay. Did they give a response to you from your fax?
Pattinson: No, they didn't.
Det. Schaffner: Did Mary say anything about getting information from them about your fax?
Pattinson: No. I never received any kind of reply about that.
Det. Schaffner: As we had discussed previously, this incident occurred in...in June of 96. It's now being reported in May of 97.
Pattinson: Actually April 97.
Det. Schaffner: April of 97...I'm sorry. Why the delay?
Pattinson: Umm...because umm...until recently I was still a member of the Church and I was trying to handle this and deal with it within the confines of the Church because I knew that...that something illegal had occurred at that particular time. But I was scared of going to the police about it. I did think about doing that.
Det. Schaffner: Why would you not go to the police?
Pattinson: Because internal Church policies by Ron Hubbard prevent you going to seek justice other than inside the Church to start off with unless you receive a reply from the International Justice Chief telling you to go to the police or the authorities or sue or bring civil suit or something like that for an illegalact. And frankly, quite apart from the written thing is that the group agreement on this is that one doesn't go to the police because the police are the enemy.
Det. Schaffner: Okay.
Pattinson: I'm sorry to have to say that, but that's like the internal feeling.
Det. Schaffner: So that's why you did not report this to the police?
Pattinson: Yes...and I tried...
Det. Schaffner: Until this time.
Pattinson: That's right. And I was trying to deal with it within the confines of the Church the whole time because I thought I was gonna be...continue to become a member...to be a member rather and to continue. But in April...actually April...I remember April 8th was that report date...that long report.
Det. Schaffner: You're talking about...
Pattinson: The long ten page report, which I wrote...a ten page report if I can find it here...
Det. Schaffner: April 8th of 97?
Pattinson: April 8th...right. So the 8th of April I wrote this report up of the whole situation which I have had with the Church of Scientology over the last six years. And it suddenly hit me that I was not gonna get anywhere doing this within the Church. At that point, I decided okay, I've used up all of my resources apparently within the Church and now I'm gonna go to the police with it because this is not gonna occur.
Det. Schaffner: So the Church did not respond to your request to review this action or to make it right?
Pattinson: No.
Bet. Schaffner: So at that point you are no longer a member of the Church and...
Pattinson: Uh Huh. I decided that I did...
Det. Schaffner: And that you would come to the Police Department.
Pattinson: That's right. I decided that I did not wish to be a part of that group anymore considering what had occurred between me and them for the last six years. I decided that that was not...not a group I wished to be a part of anymore.
Det. Schaffner: So they no longer influence your decisions?
Pattinson: No...no. And at that point, I became free to do what I wished and I decided to go to the police and to file a complaint.
Det. Schaffner: Okay.
Pattinson: I didn't even know who to go to see.
Det. Schaffner: And you came to the Police Department on your own free will?
Pattinson: Yes, I did.
Det. Schaffner: You're making this statement on your own free will?
Pattinson: Yes, I am.
Det. Schaffner: And you know it's still being recorded.
Pattinson: That's right.
Det. Schaffner: After talking with you, I had a...had you signed a Law Enforcement Oath Form indicating that you want to prosecute and what you've told us is the truth.
Pattinson: Yes, that's correct.
Det. Schaffner: You signed that freely?
Pattinson: Yes, I did.
Det. Schaffner: Voluntarily?
Pattinson: Yes.
Det. Schaffner: You would like to prosecute this case?
Pattinson: Yes, I would. If the State Attorney considers it is a case worthy of prosecution and that I am a victim of a criminal act, then I will prosecute. I...I will abide by the decision of the Assistant State Attorney or the State Attorney.
Det. Schaffner: Okay. Det. Miller, do you have any additional questions?
Det. Miller: No.
Det. Schaffner: Okay. This will conclude the interview. It's...the time now is 1810 hours.
