On the 31st of
January 1984, this writer received the following
information from a confidential source.
The source told
this writer one of the persons posing as a
businessman wanting to purchase property and make
investments in the Clearwater area is a private
investigator named Fred Kane. Mr. Kane works for
Richard Bast.
Fred Kane is a
retired Metro Washington D.C. police officer.
Kane was born 01
November 1983, address xxxxxxxxxxxx, telephone
number xxx-xxx-xxxx.
On the 1st of
February 1984, writer contacted John Fitzgibbons
of the U.S. Attorney's Office in Tampa reference
the newspaper articles concerning Clearwater
businessmen and Scientology.
This investigator
asked Mr. Fitzgibbons if the Clearwater Police
Department could talk to the Clearwater
businessmen mentioned in the article to ascertain
if a state statute had been violated. Mr.
Fitzgibbons told this writer he preferred if this
agency did not do any follow-up with the
businessmen at this time as the FBI agents were
going to interview these people. Mr. Fitzgibbons
did not want to get these people inundated with
questions from various investigative bodies.
Shortly after this
investigator spoke with Mr. Fitzgibbons, Scott
Hopkins, an investigator for the Pinellas State's
Attorney's office, contacted this writer.
Investigator
Hopkins asked this writer who the Federal
officials were in charge of the Krentzman case.
Mr. Hopkins further stated he was under
instructions from State's Attorney James T.
Russel to look into the situation involving the
Scientology operatives and Clearwater
businessmen, see attached article.
This investigator
told Mr. Hopkins to contact Attorney John
Fitzgibbons of the U.S. Attorney's Office.
Later on in the
afternoon of the 1st of February I recontacted
Mr. Hopkins. Mr. Hopkins told me he had talked
with Mr. Fitzgibbons in Tampa. Mr. Fitzgibbons
asked his agency not to interview the local
businessmen at this time. Mr. Fitzgibbons
explained to Mr. Hopkins the operation conducted
by the Scientology operatives is only part of a
total federal investigation. Mr. Hopkins then
contacted Mr. Russell via radio and asked him for
instructions. Mr. Russell told Mr. Hopkins to
10-22 (disregard) the investigation at this time.
Mr. Hopkins told
me Mr. Merkle and Mr. Russell have talked about
the Scientology operation against local
Clearwater businessmen and have reached some sort
of agreement which is unknown to him at this
time.
Writer assured Mr.
Hopkins I would maintain contact with him
concerning Scientology and Mr. Hopkins assured
this writer of the same considerations.
On the 1st of
February 1984, a confidential source approached
this writer regarding the following.
The source gave
this writer two documents, one an affidavit of
Richard Bast and one a Declaration of Robert S.
Keefer. Both of these documents were filed in the
Federal Middle District Court in Tampa in the
case of Tonja C. Burden vs. the Church of
Scientology, ET.AL.
The substance of
the two documents are as follows:
Mr. Bast and Mr.
Fuller leased a boat to covertly interview
several prominent businessmen in attempt to
ascertain their stance on Scientology.
Mr. Bast and Mr.
Keefer were hired by Attorney Paul Johnson to
cultivate information concerning a conspiracy
against Scientology.
The copies of
Richard Bast's affidavit and Robert Keefer's
declaration are attached.
On or about the
12th of January 1984 writer was contacted by
Boston Attorney Michael Flynn reference the
following information.
Attorney Flynn
stated that in reference to the Scientology
organization attempting to entrap judges involved
in Scientology cases, Mr. Flynn has developed
further information. Mr. Flynn stated in one of
his civil cases pending against Scientology, he
files a motion for discovery of some cassette
tapes. Mr. Flynn received the cassette tapes from
the Scientology organization and most of the
cassette tapes involved his client in coversation
with various members of the Scientology
organization. Mr. Flynn stated the Scientology
organization mistakenly sent him a tape
concerning a conversation between a private
investigator named Richard East and a subject
named John Safron. Mr. Flynn identified John
Safron as a disbared lawyer who has engaged in
Scientology operations in the past.
Mr. Flynn stated
the subject matter of the conversation between
Richard Bast and Safron is one in which subject
East tells Mr. Safron he has engaged in some
operations for Scientology against some federal
judges.
Mr. Flynn states
that through his sources he has reason to believe
that a subject named John Warnock is attempting
to influence high government officials in the
Department of Internal Revenue Service on the
disposition of the IRS tax case versus
Scientology. Mr. Flynn states the subject Warnock
is a former IRS attorney who left the IRS to
resume private practice. Mr. Flynn states the
confidential source has told him that Mr. Warnock
received a feeof $1 million from the Scientology
organization to represent them in the IRS tax
case. Mr. Flynn further stated that Warnock has
been attempting to influence high IRS officials
in reaching a settlement with Scientology opposed
to having the court rule against Scientology. Mr.
Flynn stated sources have told him that in all
probability the federal district judge presiding
over the IRS vs. Scientology case has been
compromised by the Scientology organization. Mr.
Flynn states he does not have proof of this
allegation at this particular time, but he
believes this did happen.
The following is
an accounting of events involving Scientology
investigation from 20 December to present 24
January 1984. Around the 20th of December 1983 I
was contacted by Attorney Michael Flynn regarding
the following information.
Mr. Flynn relayed
to this investigator the Scientology organization
conducted more than one covert operation against
various judges presiding over cases involving
litigants and the Scientology organization.
Mr. Flynn referred
to two cases in particular, the first case
involved Federal Judge Ben Krentzman (now
retired). Judge Krentzman was presiding over the
Tonja Burden civil case in 1982, the time of the
covert Scientology operation. Mr. Flynn told this
investigator he learned through various sources
Scientology agents and a private investigator
named Richard Bast leased a large boat as a base
of operations against Judge Krentzman. The boat
was supposedly loaded with drugs and prostitutes.
The prostitutes were hired to entice Judge
Krentzman while he was aboard this boat. The
private investigator Bast was paid around
$250,000 for this operation.
Mr. Flynn told
this investigator the operation was approved by
the highest officials of Scientology, including
L. Ron Hubbard, David Miscavage, Ann and Pat
Broeker. Mr. Flynn told this writer he did not
believe the operation against Federal Judge Ben
Krentzman was a success. Mr. Flynn stated his
sources have told him there were other operations
against other judges presiding over Scientology
cases and there have been successful operations
against Federal judges by the Scientology
organization in the past.
Mr. Flynn believes
that the Scientology operatives conducted an
operation against a Florida State Judge who was
presiding over the Gabe Cazares case in Daytona
Beach.
Mr. Flynn also
believes the Scientology organization conducted a
covert operation against the Federal Judge
presiding in the IRS tax case in Washington, D.C.
This writer
contacted U.S. Assistant Attorney John
Fitzgibbons concerning this information. Mr.
Fitzgibbons appeared to be aware of the situation
involving Federal Judge Ben Krentzman.
On the 23rd of
December this investigator received a newsletter
from Mr. Flynn's office in Boston. Mr. Flynn then
telephoned me in conjunction with receiving the
newsletter. Mr. Flynn informed me the authors of
the newsletter in question was John Nelson and
David Mayo. Mr. Nelson was formerly in charge of
the "watch-dog committee" of the
Scientology in California. The watch-dog
committee is an organization whose aims and goals
are the protection of Scientology. David Mayo was
an executive director of the Church of
Scientology in California and considered one of
the leading experts in the field of Scientology
technology and application of Scientology
practices. Mr. Mayo and Mr. Nelson are in a
partnership together in Santa Barbara, California
in a corporation known as Advanced Abilities
Incorporated, this corporation is a splinter
group from the Church of Scientology and uses
many of the practices and the technology of
Scientology in their operations.
The newsletter is
five pages long and is mostly composed of
Scientology gossip. The last story in the
newsletter (see attachment) concerns itself with
the Scientology operation mentioned by Mr. Flynn
concerning Federal Judge Ben Krentzman. In the
newsletter version two Scientologists named Steve
Marlowe and Vicki Aznaran retained the services
of Mr. Bast for around $250,000. The newsletter
went on to say Mr. Bast was to do whatever was
necessary to compromise a federal judge in order
to gain a favorable ruling in a case involving
Scientology.
The investigator
went on annual leave from December 27, 1983 to
January 7, 1984. During this time frame I was
contacted by Attorney Michael Flynn several times
regarding the situation involving the federal
judge. During these contacts Mr. Flynn indicated
that he was attempting through a source of his
named Bill Franks to induce John Nelson to
testify before law enforcement and prosecution
authorities about the federal judge caper. Mr.
Flynn further stated he had been in contact and
conversation with Assistant U.S. Attorney John
Fitzgibbons concerning the situation. Mr.
Fitzgibbons was negotiating with John Nelson's
attorney Gary Bright to bring Nelson to Florida
to testify under a contract of immunity.
When this
investigator returned from annual leave, contact
was re-established with John Fitzgibbons
concerning the federal judge case. Mr.
Fitzgibbons confirmed the immunity talks between
his office and John Nelson's lawyer Gary Bright
of Los Angeles. Mr. Fitzgibbons told this writer
when Mr. Nelson came to Florida I could sit in on
the meeting and the debriefing of John Nelson.
On or about the
11th of January 1984, Clearwater Sun reporter
George Wayne Shelor approached this writer
concerning comments about a story he was
developing involving a federal judge. Mr. Shelor
stated he had confidential sources in California
and Seattle, Washington who relayed to him the
following story.
Mr. Shelor stated
these sources told him a federal judge in this
district in Florida was presiding over the case
involving Scientology and Scientology operatives
attempted to compromise this judge. Mr. Shelor
further stated the operation was to involve a
large boat. The boat was to be stocked with drugs
and prostitutes and that the federal judge was to
be brought aboard and then compromised. This
writer did not make any comment whatsoever to Mr.
Shelor concerning his information and this
investigator would not confirm or deny the story.
The following
morning on the 12th of January I contacted U.S.
Assistant Attorney John Fitzgibbons and let him
know that Clearwater Sun reporter George Shelor
had all the facts in the case Mr. Fitzgibbons was
investigating and Mr. Shelor would probably be in
contact with either Fitzgibbons or U.S. Attorney
Bob Merkle.
On the 12th of
January 1984 this investigator and Chief Klein
met with the publisher of the Clearwater Sun,
Richard Cosgrove, reporter George Wayne Shelor,
and editor in chief Sam Finton. The management of
the Sun agreed not to print their story
concerning the operation involving the federal
judge until approval was granted by the U.S.
Attorney's Office in Tampa.
On or about the
24th of January 1984 this investigator met with a
confidential source. The confidential source
stated he had traced a boat named TRIANON. This
boat was docked at Clearwater Marina from March
26th through April 14, 1982. The boat Trianon is
listed out of Washington, D.C. The owner of the
craft is a Robert Keefer who is connected with
the corporation named Corporate Finances
Association Incorporated of Los Angeles.
The confidential
source stated that during the time frame this
craft was in Clearwater, Mr. Keefer along with
another subject named Rolland F. Perry
entertained local businessmen who are influential
in the Clearwater community. The names of these
businessmen are David Carley, President of the
Bank of Clearwater, Al Bomstein, a
realtor/developer, and Tim Johnson, a real estate
attorney who is extremely prominent in
development real estate business in the
Clearwater area. The confidential source stated
the purpose of the Clearwater businessmen's visit
to the craft Trianon was to interest Mr. Perry
and Mr. Keefer in investments in the Clearwater
area. Mr. Keefer told the group of Clearwater
businessmen they (meaning his corporation) were
representing some financiers who have old world
european money to invest in this part of Florida.
The three
Clearwater businessmen went aboard the Trianon
and discussed business with Mr. Perry and Mr.
Keefer concerning investments in the Clearwater
area. While aboard the Trianon the businessmen
observed the crew members were dressed all in
white, the crew members being two men and a
female. One of the businessmen made a comment to
Perry and Keefer that the crew members looked
like Scientologists. At this point both Mr. Perry
and Mr. Keefer became extremely cold to the
Clearwater businessmen.
Mr. Carley
arranged to meet Mr. Keefer at the Harborview
Club for lunch to continue the discussions later
on that week. Mr. Carley mentioned to Mr. Keefer
that Attorney Michael Flynn was addressing a
group of Clearwater businessmen concerning the
Charitable Solicitations Ordinance and its impact
upon the business community in Clearwater. Mr.
Carley told Mr.Keefer he would be interested in
what Mr. Flynn had to say and he should attend
the luncheon. Later on that week Mr. Carley
received a phone call from a female who Mr.
Carley believes was the female crew member aboard
the yacht Trianon, the female stated that Mr.
Keefer would be joining Mr. Carley for lunch on
the appointed day mentioned before. Mr. Reefer
did not show up at his luncheon appointment with
Mr. Carley and none of the three Clearwater
businessmen have heard from Mr. Keefer or Mr.
Perry again about any transactions involving
investments in the Clearwater area.
The confidential
source checked with the U.S. Coast Guard and
other sources concerning the yacht Trianon. His
information is there is only one Trianon
registered and it is registered to Robert Keefer
of Baltimore, Maryland. The Trianon listed to Mr.
Keefer is listed as 31' long.
The confidential
source interviewed City personnel at the
Clearwater Marina concerning the yacht Trianon.
City employees interviewed by the confidential
source state Mr. Keefer paid for the slip the
Trianon was docked from March 26th to the mid
part of April. Mr. Keefer paid the rental slip
fees in cash. Mr. Keefer listed the Trianon at
81' long on the rental slip documents.
This investigator
contacted Sgt. Clark Randall of the San Jose,
California Police Department in reference to Mr.
Keefer and Mr. Perry and their corporation
Corporate Finances Association Incorporated. Sgt.
Randall stated that he checked with the Secretary
of Commerce of the State of California and
discovered Corporate Finances Association
Incorporated is not listed in the corporate stats
in the State of California. Sergeant Randall
could not ascertain any information on Mr. Keefer
or Mr. Perry without the correct dates of birth.
Investigation
continues.
On the 23 of
January 1984 writer received from a confidential
source an article which was dated December 1980
entitled "Scientology's War Against
Judges".
This article appeared in The American Lawyer in
December of 1980, the author of the article is a
James E. Stewart, Jr.
In reviewing the
article the following information was stated.
Scientology conpromised a federal judge named
Richey in the 1978 Scientology case against Mary
Sue Hubbard. Prior to Judge Richey's problems
with Scientology, two other judges were assigned
to this case and both judges were compromised by
Scientology.
When this
investigator refers to compromise it means
Scientology conducted covert operations against
these judges which involved prostitutes. The
article states the Scientology organization hired
a private investigator named Richard Bast to
compromise Judge Richey and other judges assigned
to this particular case. The article goes on to
state that Richard Bast was paid $321,000 for
this operation.
This investigator
sent this information on to U.S. Attorney John
Fitzgibbons at his office in Tampa.
